Terms and Conditions

1. Your Account

Although your membership is completely free, you have the right to close your account at time. To do this, send an e-mail to info@nobraina.co.uk. Only one account per UK resident. You must be living in the UK to qualify for an account and to receive cashback from our retailers. We reserve the right to refuse membership, and to modify, suspend or close an account if we suspect fraudulent, abusive or un-fair behaviour. We also reserve the right to close an account if it appears to be dormant. As a condition of your membership you must accept e-mails from No Braina containing important announcements and updates about our service.

 

2. Cashback Payments

As a member of No Braina, you are able to earn ‘cashback’ by shopping with our advertised retailers. Please note that transactions will be made with the retailer, not us. Once a purchase has been made the retailer will pay us a commission for referring you as a customer. A percentage of this commission will be passed on to you in the form of ‘credit’ within your No Braina account. We are able to trace the transaction to your No Braina account by means of an identification tag provided in the reports of the merchants and their tracking agencies (see section 4).

Sometimes retailers will change the amount of commission they pay us, which means that the cashback amount you receive may differ from that advertised on our website. Please note that once a purchase has been made the retailer can take several days to pay us commission, therefore it may take several days after your purchase has been made for credit to appear in your account. If the goods are returned or the sale reversed or amended by any means then the cashback payment will not be made. Once your account credit has reached a minimum threshold, you may request for funds to be transferred to you via one of the payment methods we offer. Once we have received a pay-out request, we may take up to 30 days to make the payment. This may be longer during extremely busy periods.

We reserve the right to change the minimum pay-out threshold at any time without prior notice. Please note that you must login to your account via the No Braina website and click on the retailer’s link in order for your purchase to qualify for cashback. We cannot be held responsible if the retailer fails to report your sale to us. Merchants have their own rules upon which they determine transactions to be genuine, i.e. An attempt to simply earn money by clicking/registering with no intention to continue to use/buy from their website could be deemed as non-genuine. These rules may or may not be advertised by ourselves or the retailer and may be discretionary.

Sometimes, due to errors, your purchase may not be tracked and your account may not be credited. If you believe you are due credit and it has not appeared in your account, please contact us and we will attempt to resolve the issue. Whilst we will endeavour to recover non-payments from the retailer, the decision of ourselves, the retailer or retailer’s tracking agent is final. Whilst we will try and recover missing cashback, at any point we reserve the right not to chase missing cashback claims, particularly where no purchase has been made. Should a retailer delay payment or cease trading then we will make every reasonable effort to recover your cashback but we can make no guarantees to payment until funds have been received from the retailer or their agents. We reserve the right to reclaim or make balance adjustments accordingly where it has been established that any credit has been applied in error. This will include but is not limited to transactions where the credit is not genuinely due or payment for any credited transaction has not been received from a merchant or its agencies. We reserve the right to apply fraudulent prevention measures as we see fit. At times we may offer a ‘sign-up’ or ‘refer-a-friend’ bonus in the form of credit added into a user’s account. We reserve the right to alter the amount of bonus credit offered at any time without prior notice. For referrals to be paid, the referred member must meet certain criteria set by us, such as minimum thresholds. The criteria used to determine referral thresholds may be adjusted at any time. We reserve the right to withhold or deny bonus credit payments if we suspect fraudulent or un-fair behaviour.

Individual payment methods may be limited or withdrawn on a discretionary basis to ensure only UK payment transactions are made as per our membership terms. Payment details must be kept accurate by yourself to avoid losing any due payments. Payments made to incorrect destinations are not always recoverable and may be subject to a recovery fee. We will not be held liable for any delays, or consequences of delays in payment. At any point we reserve the right to put payment requests on hold pending any investigation, this may be the case where unusual account activity is detected and verification is therefore required in order to deem the transactions as genuine.

Please note that some retailers will not include VAT or postage & packing costs when calculating your cashback percentage. Some retailers also have complex commission structures and different rules regarding items such as gift vouchers, reduced items, custom made items and so on. Because of this, the commission advertised on our site will sometimes represent the average cashback paid by the retailer - the cashback you receive may be different.

 

3. Privacy Statement

We are committed to protecting your privacy. Authorised employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

 

4. Cookies

Although we no do not use cookies on our website, a cookie may be placed on your computer when you click on a link to one of our retailer’s sites. This is necessary in order to track your purchase back to you No Braina account and add the correct amount of credit to your account.

 

5. Links to this website

We are happy for other external websites to link to www.nobraina.co.uk. However we do not permit pages to be loaded into frames on other sites, and we do not permit links from any websites that contain material which could be construed as offensive.

 

6. Links from this website

We do not monitor or review the content of other party’s websites which are linked to from this website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by us and should not be regarded as the publisher of such opinions or material. Please be aware that we are not responsible for the privacy practices, or content, of these sites. We encourage our users to be aware when they leave our site & to read the privacy statements of these sites. You should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site yourself, before disclosing any personal information to them. This Company will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.

 

7. Modification of Agreement

We may modify any of the terms and conditions contained in this Agreement, at any time and at our sole discretion for any reason. We will post the revised agreement on this website. The new terms will come into effect no later than 30 days after the modification.
